What to Do After a Car Accident in West Virginia
Call 911 and get medical care, even if you feel "okay." Some injuries show up later.
Take photos of the vehicles, the scene, your injuries and the road conditions.
Get names and phone numbers of witnesses.
Don't give a recorded statement to the other driver's insurance company.
Don't sign anything or accept a quick settlement before you know how badly you're hurt.
Call a lawyer. The sooner we start, the more evidence we can preserve.
Who Pays Your Bills?
The at-fault driver's liability insurance. The West Virginia minimum is only $25,000 per person and $50,000 per accident.
Your own uninsured/underinsured motorist (UM/UIM) coverage if the other driver has no insurance or not enough.
Your medical payments coverage, if you have it.
Other responsible parties: an employer whose employee caused the crash, a bar that over-served a drunk driver, a vehicle manufacturer or a road contractor.
We look for every source of coverage, because serious injuries usually cost far more than the minimum policy.
What You May Recover
Medical bills (now and in the future), lost wages, reduced earning ability, pain and suffering, scarring and disability, and property damage. In some cases involving reckless conduct, such as drunk driving, punitive damages may also be available.
West Virginia Deadlines and Fault Rules
You generally have two years from the crash to file a lawsuit (W. Va. Code § 55-2-12).
If you were partly at fault, you can still recover as long as your fault is not greater than the combined fault of the others. Your award is reduced by your share.

Car Accident FAQs
How much is my case worth? It depends on your injuries, your medical treatment, lost income, insurance limits and fault. We'll give you an honest assessment at your free consultation.
Should I talk to the other driver's insurance company? You must report the crash to your own insurer. Before you give the other driver's insurer a statement, talk to a lawyer.
What if the driver who hit me had no insurance? Your own uninsured motorist coverage, which is required in WV, may pay.
How long will my case take? Many cases settle once treatment is finished and the full cost of the injury is known. Cases that need a lawsuit take longer. We'll keep you informed at every step.
