What Your Case May Be Worth

Every case is different, and no honest lawyer can promise a number. Depending on the facts, West Virginia law may allow you to recover:

  • Past and future medical expenses

  • Lost wages and lost earning ability

  • Pain, suffering and emotional distress

  • Permanent injury, scarring or disability

  • Property damage

  • In wrongful death cases: funeral costs, lost income and the family's grief and loss of companionship

West Virginia Injury Law: What You Should Know

  • Deadline: Most personal injury and property damage claims must be filed within two years (W. Va. Code § 55-2-12). Some claims, such as medical malpractice claims, require written notice before suit is filed.

  • Shared fault: West Virginia uses modified comparative fault. You can still recover if you were partly at fault, as long as your share is not greater than the combined fault of the others. Your recovery is reduced by your percentage of fault (W. Va. Code § 55-7-13c).

  • Insurance minimums are low: WV drivers need only $25,000 per person in liability coverage. Serious injuries often cost more than that. Your own uninsured/underinsured motorist (UM/UIM) coverage may also pay. We look for every policy that applies.

Personal Injury FAQs

How do I file a personal injury lawsuit in West Virginia? Most cases start with an insurance claim, not a lawsuit. Your lawyer investigates, gathers medical records and bills, and sends a demand to the insurance company. If the insurer will not pay a fair amount, your lawyer files a complaint in circuit court, usually in the county where the injury happened or where the defendant lives. Both sides then exchange evidence, often try mediation, and if the case still does not settle, it goes to trial.

How long do I have to file? Most personal injury and property damage claims must be filed within two years of the injury (W. Va. Code § 55-2-12). Wrongful death claims generally must be filed within two years of the death (W. Va. Code § 55-7-6). Medical malpractice claims require written notice to the provider at least 30 days before suit is filed (W. Va. Code § 55-7B-6). Other special rules can apply, so call early.

What if I was partly at fault? West Virginia uses modified comparative fault. You can still recover as long as your fault is not greater than the combined fault of everyone else, but your award is reduced by your percentage of fault (W. Va. Code § 55-7-13c).

How much does it cost to hire an injury lawyer? Nothing up front. We handle injury cases on a contingency fee, so there is no attorney fee unless we recover money for you. You may be responsible for costs and expenses of the case, as explained in your written fee agreement.

What is my case worth? It depends on your injuries, medical treatment, lost income, insurance coverage and who was at fault. No honest lawyer can promise a number, but we will give you a straight assessment at your free consultation.

Should I talk to the other driver's insurance company? Report the crash to your own insurer, but talk to a lawyer before giving a recorded statement to the other driver's insurer or signing any release.

What if the driver who hit me had no insurance? West Virginia requires uninsured motorist coverage on auto policies, so your own policy may pay your claim (W. Va. Code § 33-6-31). Underinsured motorist coverage may also help if you bought it.

Will my case go to trial? Most injury cases settle without a trial. Preparing every case as if it will go to court is often what gets a fair settlement.

What should I bring to my free consultation? Bring anything you have: the crash or incident report, photos, insurance cards and letters, medical bills and records, and the names of witnesses. If you do not have these yet, call anyway. We can help gather them.

The answers above are general information, not legal advice. Every case is different. Contacting us does not create an attorney-client relationship.
